The Relational Contract appeared—a living document that grew with the relationship it represented.

*"The phenomenon is called 'shading.' One party feels they are being taken advantage of and decides to get even by exploiting minor loopholes. This rarely goes unnoticed. The other party shades in return. An escalating war of shading episodes until both withdraw."*

*"The two parties abandoned the idea of a traditional contract,"* the Drake said, *"realizing that a well-functioning business relationship was more important than nailing down all the details in an adversarial negotiation. The solution: 'relational contract theory'—an approach to thinking of contracts not as one-off business deals but as opportunities to construct productive and long-lasting relationships."*

*"What does a relational contract do?"*

*"It 'specifies mutual goals and establishes governance structures to keep the parties' expectations and interests aligned over the long term.' More importantly, it is 'designed from the outset to foster trust and collaboration.' And critically: it is 'especially useful for highly complex relationships in which it is impossible to predict every what-if scenario.'"*

*"This sounds like DAOs and blockchain technologies."*

*"Exactly. Those platforms provide tools that enable us to create a shared record of goals—particularly long-term ones—and a permanent record of those goals and the history of their changes. Blockchain technology facilitates trust through 'trustless' technologies like smart contracts."*

The proverb emerged: *"A 100-page contract with 'supplier shall' statements drove Dell and FedEx apart—but a relational contract brought them back together."*

The Record Keeper appeared—carrying the history of every negotiation.

*"One critical element in contract negotiation is maintaining a record of proposals. Instead of scribbling notes in no particular order, the best practice is to keep clean records of all parties' proposals and the times at which they were made."*

*"Why does this matter?"*

*"First, it avoids rehashing things that have already been agreed upon or rejected. Second, observing what has met with agreeable responses helps gauge which future proposals might be accepted."*

*"One wants the record to be immutable and recognized as valid by all parties so that one party cannot unwind from agreed-to positions,"* the Drake emphasized. *"The record should also contain information about the interpretation that all parties have assigned to what has been agreed upon. As Jacques Derrida pointed out, we have to consider the interpretation of the archive, not just the archive itself."*

*"And this continues throughout the life of the contract?"*

*"The entire life of the contract demands some way of recording proposed changes, proposed interpretations, disputes over interpretation. When each contract—or each contractual relation—is assigned a DAO in which the parties are participants, we immediately have a venue in which proposals can be discussed and guiding philosophies articulated."*

*"If those discussions are recorded on the blockchain..."*

*"Then we have a shared, immutable history of the proposals made—literally a record of proposals—as well as a forum in which those proposals can be discussed, approved, and rejected."*

The proverb settled: *"You cannot clarify something if you have lost track of what it is that needs clarification—the record of proposals is everything."*

## Royal Marriages Were Relational Contracts

The Treaty DAO materialized—a structure for agreements between communities.

*"If you think about treaties between nation states, they are, in effect, contracts between the parties. There are differences—most contracts are written within an established legal framework, while treaties often exist outside such frameworks. But they are the same in relevant respects."*

*"Party A agrees to do X, and party B agrees to do Y."*

*"If relational contract theory makes sense for contracts, something very much like it makes even more sense for international treaties. Ideally, one does not want treaties to be one-off efforts but relational treaty agreements in which the parties remain in contact and can articulate their goals and concerns."*

*"The historical practice of arranging marriages between royal family members as part of a treaty was a version of this idea,"* the Drake offered. *"By marrying into the treaty partner, one is saying the goal is a long-term relationship with that partner."*

*"So successful negotiation involves creating a temporary umbrella community?"*

*"Yes. But if we apply relational contract ideas, then we want that umbrella community to endure—perhaps indefinitely. As these communities make progress finding common ground and building shared institutions, they tend to grow closer together."*

*"Even a community of conflict?"*

*"This applies vividly to negotiating a treaty between two communities—a cyberstate and a nation state, or two blockchain communities. In negotiating, one has already created a kind of meta community—grounded in understanding that there are shared values with respect to the goals of the treaty, the methods of verification, the methods of enforcement."*

The proverb crystallized: *"Royal marriages were medieval relational contracts—treaties should be the same, designed for relationships that outlast the paper they're signed on."*

## The Bot That Watches Prisoners

The Oracle Bot appeared—a figure that observed without judgment.

*"How are traditional economic treaties verified and enforced?"*

The Drake listed the mechanisms:

*"1. Self-reporting—regular reports by signatories on implementation*
*2. Monitoring—independent organizations like WTO, IMF*
*3. Dispute resolution—neutral third-party panels or courts*
*4. Peer review—periodic reviews of implementation*
*5. Enforcement—sanctions, fines, trade restrictions"*

*"How is this different with blockchain?"*

*"With onchain information, self-reporting becomes far more successful. Onchain information is difficult to falsify since it must be consistent with information at every step of the supply chain. If it is your blockchain, misrepresenting the numbers is quite difficult."*

*"And monitoring?"*

*"If the information to be monitored is onchain, you provide access. For example, for widget production—production data, supply chain, inventory control. If that information is proprietary, you provide zero-knowledge proofs that establish reliability without revealing the underlying data."*

The Oracle Bot demonstrated:

*"A treaty might require a certain percentage of state resources be committed to some social cause. The community may not wish to reveal total resources. With a zero-knowledge proof, it can still prove it has provided the requisite percentage."*

*"What about enforcement?"*

*"If parties agree to purchase a good or service at a specific price, and the agreement is encoded in a smart contract, there is no issue whether the promise will be kept. The code executes the agreement automatically."*

*"Even for non-economic treaties?"*

*"The key involves oracles that can monitor relevant actions. If an agreement says adversarial forces must withdraw from territory, oracle bots can monitor the area. The bot's software would be under observation of members of the treaty DAO. One could engineer 'observers' that pay attention only to relevant parameters—blind to everything else—and report only to the shared DAO."*

*"Suppose we wanted a treaty regarding treatment of prisoners,"* the Drake said. *"Using current AI technology, a bot could be trained to recognize acceptable and unacceptable behaviors. The treaty might be programmed to abide by the bot's judgment. The bot reports to the DAO smart contract, which affirms whether the treaty is being observed. If not, the enforcement mechanisms kick in automatically."*

The proverb burned: *"A bot trained to recognize prisoner abuse reports to the DAO—and the smart contract automatically acts, no human bias required."*

*"Ludwig Wittgenstein said: 'If a lion could talk, we would not be able to understand it.' Communication requires more than words or syntax. Communication requires that we have a shared community with shared practices."*

*"We would not understand the lion because we do not share its community."*

*"But there is another way to look at this. If we are communicating with someone—even if we disagree about everything—we can only do that because we already share a kind of community and set of practices."*

The Umbrella Community appeared:

*"It does not matter how hopeless the disagreement appears or how deep it goes. It does not matter if it has degraded into an endless exchange of insults. You are still communicating—something you cannot do with Wittgenstein's lion. For that to be possible, there is already a community in place."*

*"Disagreements are critical components to coming to common understanding,"* the Drake said. *"If students passively nod their heads, they may not understand. But if they raise objections, they actually do understand—at least well enough to engage. So perhaps disagreement is a path to understanding. First, there must be understanding, from which disagreement emerges, and this leads to better understanding and more disagreement, and the cycle continues."*

*"So even communities in conflict form a kind of community?"*

*"Even if two parties are diametrically opposed—even engaged in kinetic conflict—if they are communicating for any purpose, they ipso facto form an umbrella community encompassing both communities in conflict."*

*"This seems paradoxical."*

*"As contradictory as it may seem, two parties in dispute—even yelling at each other—are still engaged in communicative practice. They are appealing to ideals and principles that they imagine the other party either shares or ought to share with them. This suggests more than a little common ground."*

The proverb emerged: *"If a lion could talk, we would not understand him—but if you can insult someone, you are already part of a shared community."*

*"If disagreement itself assumes some form of understanding, and can lead to future understanding, then when we establish platforms for conducting negotiations between communities in conflict, there is nothing bizarre about saying the parties constitute a working community."*

*"When two separate communities find themselves in conflict, they still constitute a kind of joint community,"* the Drake said. *"We might even say they constitute a permanent community because as long as people communicate well enough to insult one another, they are part of a shared community."*

*"So what tools do we provide?"*

*"It can only be helpful to ask parties in conflict to clearly articulate their principles and values and what their complaints against the other party are. If one finds the other to be evil, that suggests an assumption about some shared values. Even if fundamental principles are incommensurable, it is valuable to have those principles clearly articulated—if for no other reason than to know what proposals are unlikely to succeed."*

*"And if they do not trust each other?"*

*"All the more reason to take the dispute to the blockchain. Both parties will know the records are immutable and that trustless agreements are possible in the form of smart contracts."*

*"What about the broader ecosystem?"*

*"We envision various communities, organized around different principles and values, having some shared values—possibly those encoded in the Declaration of the Rights of Communities. That opens the opportunity for a meta DAO. Such a community of communities will also be organized around smart contracts."*

The Umbrella Community concluded:

*"Just as a first-order community has strategies for incentivizing positive collaboration among its members, so too will the meta DAO. These incentives might involve carrots, and they might involve sticks. But engineering collaboration at this meta level is not different from engineering it at the lower level in any interesting way."*

The proverb sealed: *"If your community and mine both want the right to exit protected, we have formed a meta DAO—and our shared smart contracts will enforce our shared values."*
